A Bayonne family has been awarded $8.5 million after a birth injury medical malpractice suit.
The lawsuit was filed against the Bayonne Medical Center and three of its employees after an incident that occurred in August 2005. The incident began when a 32-year-old woman went into the medical center when she had her first pains of labor. Before this point, all tests showed that the baby was healthy.
About eight hours after arriving at the hosptial, the baby’s heartbeat dropped dramatically. According to phone records, the nurse did not call the doctor until this went on for an hour and half. The doctor took 22 minutes to get there and the Cesarean section took another 30 minutes.
By the time the child was born, he was left permanently brain damaged from the lack oxygen that occurred when the woman’s umbilical chord was pressed down upon. This is what caused the child’s heartbeat to drop so low. The child now requires 24-hour care from his family.
