A woman was awarded $6.7 million by a jury after a medical malpractice lawsuit filed against a medical center and a surgeon after the death of her husband.
The lawsuit was filed in 2009 over an incident that occurred on Mother’s Day that ended with the woman’s husband dead. The man was involved in an ATV accident and was transported to the hospital to be treated after. Once at the hospital, a CT scan showed that the man had internal bleeding and the he suffered multiple broken ribs.
Over 36 hours after admittance, the man’s lung collapsed from the bleeding. This then caused him to have a heart attack from the lack of oxygen. The physician’s representation claim that there was no way to predict that this would happen, but the representation for the man claims that a chest tube eliminating the fluid would have prevented his death.
